Does the I-9 need to be done in person?

Historically, the I-9 form required that work authorization and identity documents be physically examined in person. However, there have been recent changes offering an alternative procedure for employers enrolled in E-Verify. This alternative procedure allows for remote examination of an employee’s Form I-9 documents provided you meet the requirements.

Section 2 of Form I-9 must be completed by the employer or their authorized representative. This section involves reviewing the employee’s identity and employment authorization documents and recording the necessary information. The employer or representative must physically examine each document to determine if it reasonably appears to be genuine and relates to the employee presenting it. It’s important to note that while employers can designate a representative to complete this section, they are still legally responsible for any violations in connection with the form or the verification process.

I-9 reverification is the process of re-confirming an employee’s eligibility to work in the United States when their initial work authorization, as documented in Section 2 of the original I-9 form, is about to expire. This involves the employee presenting updated or new work authorization documents, which the employer must then review and record in Supplement B (formerly Section 3) of the original I-9 form or on a new form if Section 3 is already used.
